BIN WAITE WEBSITE TERMS AND CONDITIONS OF SALE

Effective date: July 1st 2026

1. About Bin Waite

This website and the products sold through it are operated by:

2. Application of these terms

These Terms and Conditions apply to:

  • Purchases made through the Bin Waite website
  • Pre-orders
  • Orders accepted by email or invoice
  • Standard consumer orders
  • Commercial and bulk enquiries, unless separate written terms are agreed

By placing an order, submitting payment or accepting a written quotation, you agree to the version of these Terms and Conditions provided or published at that time.A separate written commercial agreement or accepted quotation will take priority where it expressly differs from these website terms.

3. Product purpose

Bin Waite is a purpose-built internal bin weight designed to sit at the bottom of a compatible bin.By adding mass at the lowest point of the bin, Bin Waite is intended to help lower the bin’s centre of gravity and improve stability during windy conditions.Bin Waite may help reduce:

  • Empty or lightly loaded bins tipping over
  • Bins moving away from the kerb or driveway
  • Rubbish spilling onto streets or neighbouring properties
  • Repeated bin retrieval and clean-up in exposed locations

Bin Waite improves stability but does not guarantee that a bin will never move, tip over, become damaged or spill its contents.Performance may vary depending on factors including:

  • Wind speed and direction
  • Bin size, brand and model
  • The condition of the bin
  • The quantity and distribution of waste inside the bin
  • Ground slope and surface
  • Bin positioning
  • Surrounding buildings, fences and vegetation
  • Installation quality
  • External impact or interference

4. Sizes, brands and product variants

Bin Waite is offered in versions designed for selected:

  • 80L bins
  • 140L bins
  • 240L bins

Different bin brands and models may have different internal floors, ribs, wheel housings, moulds and dimensions.Bin capacity alone does not establish compatibility.Customers must select the correct Bin Waite variant for their bin’s:

  • Capacity
  • Manufacturer
  • Brand
  • Model
  • Mould or internal floor design

Each compatible brand or mould may have a separate product variant and SKU.

5. Compatibility information

Before ordering, the customer must provide or confirm accurate information about the bin, including where requested:

  • Bin capacity
  • Manufacturer or brand
  • Model or identification markings
  • Photographs
  • Internal base shape
  • External base shape
  • Relevant measurements

The customer is responsible for ensuring that information supplied to Bin Waite is accurate.Where Bin Waite confirms compatibility in writing based on complete and accurate information supplied by the customer, Bin Waite will stand behind that fitment confirmation.Where the customer supplies incorrect or incomplete information, selects the wrong variant despite clear compatibility information, or installs the product in a different bin, the change-of-mind and incorrect-selection provisions of these terms may apply.Do not drill the bin or install the product if Bin Waite:

  • Does not sit flat in its intended position
  • Interferes with wheels or moving components
  • Contacts internal ribs incorrectly
  • Does not align with the supplied drilling template
  • Appears incompatible with the bin

Contact Bin Waite before proceeding if there is any uncertainty.

6. Product specifications

Approximate Bin Waite product weights are:

  • 80L Bin Waite: approximately 7 kg
  • 140L Bin Waite: approximately 7 kg
  • 240L Bin Waite: approximately 12.5 kg

Weights may vary slightly because of reasonable manufacturing tolerances and natural variation in the recycled material. Bin Waite is manufactured using recycled tyre combined with a durable binding system and installation hardware. Because recycled tyre is used, minor differences may occur in:

  • Colour
  • Surface texture
  • Rubber flecking
  • Pattern
  • Finish
  • Exact weight

Minor cosmetic variation that does not affect fit, safety or function is not normally considered a fault.

7. What is included

Unless the relevant product page states otherwise, each standard Bin Waite installation kit includes:

  • 1 × Bin Waite internal bin weight
  • 4 × stainless-steel fixing bolts
  • 4 × fixing washers suitable for the relevant model
  • 1 × drilling template
  • 1 × installation guide
  • 1 × compatibility and safety information sheet

The bin itself is not included.Drills, drill bits, hand tools and personal protective equipment are not included unless expressly stated.

8. Bin ownership and permission

Many council-issued bins remain the property of the council, waste authority, property owner, strata body or waste contractor.Before drilling or modifying a bin, the customer must confirm that:

  • They own the bin; or
  • They have permission from the bin owner to modify it

Purchasing Bin Waite does not provide permission to drill or modify a council-owned, rented, leased, strata-owned or third-party-owned bin.The customer is responsible for obtaining any required approval before installation.

9. Installation requirements

Standard Bin Waite installation requires four holes to be drilled through the base of the bin.The customer must:

  • Read the supplied instructions before beginning
  • Confirm that the product and template match the bin
  • Empty and clean the bin
  • Position the template correctly
  • Check all drilling locations before drilling
  • Use appropriate tools and personal protective equipment
  • Install the supplied bolts and washers correctly
  • Tighten each fixing evenly
  • Confirm that Bin Waite is secure before using the bin

Do not over-tighten the fixing hardware, as this may damage or distort the bin floor.Customers who are not confident performing the installation should use a suitably competent installer.Use safe lifting practices when handling Bin Waite. Seek assistance where necessary, particularly when handling the approximately 12.5 kg product.

10. Collection and maximum-weight requirements

Bin Waite adds permanent weight to the bin.The combined weight of:

  • The empty bin
  • Bin Waite
  • The bin contents

must remain within any limits imposed by the:

  • Council
  • Waste contractor
  • Bin manufacturer
  • Collection vehicle operator
  • Relevant property owner

Customers should not install or use Bin Waite where the council, bin owner or collection contractor prohibits bin modifications or additional weight.

11. Orders and acceptance

Submitting an order does not guarantee acceptance.An order is accepted when:

  • Payment has been successfully processed; and
  • Bin Waite issues an order confirmation or otherwise confirms acceptance in writing

We may contact the customer before accepting or dispatching an order to verify compatibility.We may decline or cancel an order for a reasonable cause, including:

  • The selected product is unavailable
  • The product cannot be delivered to the nominated address
  • There is an obvious pricing or listing error
  • The transaction is suspected to be fraudulent or unauthorised
  • The product is known to be incompatible with the nominated bin
  • Required customer information has not been supplied
  • Supplying the product would create a safety or legal concern

Where Bin Waite cancels an order after payment, the customer will receive a full refund of the amount paid for the cancelled order.

12. Prices, GST and payment

All consumer prices are displayed in Australian dollars and include GST unless clearly stated otherwise.The total amount payable will be displayed before the customer completes the purchase.Where a product page states that standard shipping is included, no separate standard shipping charge will be added for an eligible delivery address.Additional delivery charges may apply to:

  • Remote locations
  • Islands
  • Locations outside the stated delivery area
  • Bulk or palletised orders
  • Special-access locations
  • Commercial freight
  • Redelivery caused by an incorrect address

Any additional unavoidable charge will be disclosed before the order is accepted.The advertised total price must include GST and unavoidable charges, and claims about pricing, delivery times and product performance must be clear and accurate. 

13. Pre-orders

Products marked Pre-order are not available for immediate dispatch.Unless otherwise stated:

  • Full payment is collected when the pre-order is placed
  • The estimated dispatch date or timeframe will be shown on the product page, checkout, order confirmation or written quotation
  • The dispatch estimate begins from the time stated in the product listing
  • Delivery time is additional to the manufacturing and dispatch period

Estimated dispatch dates are not guaranteed dates. Manufacturing, material, quality-control or freight issues may affect timing.If the estimated dispatch timing materially changes, Bin Waite will notify the customer and offer:

  • The revised dispatch estimate; or
  • Cancellation of the undelivered pre-order for a full refund

A customer may cancel a standard pre-order at any time before dispatch and receive a full refund.Different cancellation provisions may apply to custom-branded, specially manufactured or commercial orders where those provisions are clearly stated and accepted in a separate quotation or agreement.If Bin Waite cannot supply a paid pre-order, the customer will receive a full refund.

14. Dispatch and delivery

Dispatch estimates refer to when the order leaves Bin Waite or its fulfilment location. Delivery estimates refer to the time taken by the carrier after dispatch.Customers must provide a complete and accurate delivery address.Bin Waite is not responsible for a delay caused solely by:

  • Incorrect customer address information
  • The customer not being available to receive the delivery
  • Carrier disruption outside Bin Waite’s reasonable control
  • Severe weather
  • Road closures
  • Natural disasters
  • Government or emergency restrictions

However, Bin Waite remains responsible for meeting its obligations under Australian Consumer Law.Where redelivery is required because the customer supplied an incorrect address or failed to collect the parcel, Bin Waite may charge the reasonable, actual redelivery cost.

15. Delivery inspection

Customers should inspect the shipment reasonably promptly after delivery.If an order arrives damaged, incomplete or incorrect, contact Bin Waite and provide:

  • The order number
  • A description of the issue
  • Photographs of the product
  • Photographs of the packaging
  • Photographs of any visible damage
  • Details of missing items

Do not install a product that appears damaged, incomplete or incorrect.Prompt reporting helps us investigate the issue, but nothing in this clause imposes an unlawful time limit on rights under Australian Consumer Law.

16. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.Customers may be entitled to a repair, replacement, refund, cancellation or compensation where a product:

  • Is faulty
  • Is unsafe
  • Is not of acceptable quality
  • Does not match its description
  • Does not perform as represented
  • Is not fit for a purpose disclosed to Bin Waite
  • Is materially different from the product ordered
  • Fails to meet another applicable consumer guarantee

The appropriate remedy depends on whether the issue is major or minor and on the circumstances.Any voluntary warranty offered by Bin Waite is in addition to, and does not replace, rights under Australian Consumer Law. Consumer guarantees are automatic and can continue beyond the period of a manufacturer’s voluntary warranty. 

17. Making a fault or warranty claim

To make a claim, contact:hello@binwaite.com.auPlease provide:

  • Name
  • Order number or other proof of purchase
  • Product variant
  • Description of the issue
  • Photographs or video where reasonably required
  • Installation details
  • Bin brand and model

The customer may be asked to stop using the product while the issue is assessed.Where the product is confirmed to be faulty or incorrectly supplied and the customer is entitled to a remedy, Bin Waite will cover or reimburse reasonable return-delivery costs as required by law.Original packaging is helpful but is not required for a valid Australian Consumer Law claim.

18. Change-of-mind returns

In addition to rights under Australian Consumer Law, Bin Waite accepts change-of-mind returns where:

  • The customer contacts Bin Waite within 14 days after delivery
  • The product has not been installed
  • No holes have been drilled using the product or template
  • The product has not been used
  • The product has not been damaged
  • All hardware, instructions and supplied components are returned
  • The product is packaged securely for return

The customer is responsible for change-of-mind return freight.No restocking fee will apply.A refund will be processed after the returned product has been received and inspected.Change-of-mind returns are not available for:

  • Installed products
  • Products damaged after delivery
  • Products altered by the customer
  • Custom-branded products
  • Bespoke or specially manufactured commercial orders

This clause does not restrict any rights relating to faulty, unsafe, incorrectly described or incorrectly supplied goods.

19. Incorrect customer selection

Where the customer orders the wrong brand, model or mould despite clear compatibility information, the change-of-mind return provisions apply.The customer is responsible for:

  • Return freight
  • Any additional freight required to send the replacement variant
  • Any product damage caused by attempting to install the wrong variant

No replacement or refund is available under the change-of-mind policy after the product has been drilled, modified or installed.This does not apply where:

  • Bin Waite supplied a different product from the one ordered; or
  • Bin Waite provided an incorrect written compatibility confirmation based on accurate information supplied by the customer

In those circumstances, Bin Waite will arrange an appropriate remedy and reasonable freight at its cost.

20. Cleaning and maintenance

Customers should periodically check that:

  • All four bolts remain secure
  • Washers remain correctly positioned
  • The product remains seated correctly
  • The rubber body is not damaged
  • The bin floor has not cracked or distorted
  • Waste has not become trapped around the edges
  • The installation does not interfere with bin operation

Clean Bin Waite and the bin floor using water and ordinary household bin-cleaning products.Do not use harsh solvents or chemicals that may damage:

  • The recycled tyre
  • The binding system
  • Washers or seals
  • Metal hardware
  • The plastic bin

Stop using the product and contact Bin Waite if the product, fixing system or bin floor appears damaged.

21. Misuse, alterations and unauthorised installation

Customers must not:

  • Cut or modify Bin Waite
  • Drill additional holes into the product
  • Substitute unsuitable hardware
  • Install the product in an incompatible bin
  • Install the product without the bin owner’s permission
  • Exceed applicable bin or collection-weight limits
  • Continue using damaged or loose hardware
  • Use Bin Waite for a purpose other than its intended purpose

To the extent permitted by law, Bin Waite is not responsible for damage caused by:

  • Incorrect customer information
  • Installation contrary to the supplied instructions
  • Unauthorised modification of the product or bin
  • Use in an incompatible bin
  • Overloading
  • Failure to inspect or maintain the installation
  • Existing bin damage or deterioration
  • Use of unsuitable replacement hardware

This clause does not apply to the extent that the damage was caused by a product defect, Bin Waite’s negligence, a misleading representation or another breach of law.

22. Commercial, council and bulk orders

Orders for councils, waste contractors, strata managers, property managers and other organisations may be subject to separate conditions, including:

  • Minimum order quantities
  • Compatibility assessment
  • Trial or pilot arrangements
  • Volume pricing
  • Custom branding
  • Freight charges
  • Production schedules
  • Installation requirements
  • Deposits
  • Milestone payments
  • Written approval processes

Those conditions must be recorded in a written quotation or agreement.Nothing in a commercial quotation excludes any Australian Consumer Law rights that legally apply to the transaction.

23. Website information

Bin Waite takes reasonable steps to ensure that product descriptions, prices, compatibility information and images are accurate.Minor visual variation may occur because recycled material is used.Website content does not replace:

  • Product-specific installation instructions
  • Safety information
  • Compatibility confirmation
  • Council or waste-contractor requirements

If website content conflicts with the safety instructions supplied with the product, follow the safety instructions and contact Bin Waite before proceeding.

24. Intellectual property

The Bin Waite name, logo, product design, photographs, artwork, instructions, templates, website content and marketing materials are owned by Bin Waite or used under licence.They must not be copied, modified, reproduced, manufactured, sold or used commercially without written permission.

25. Privacy and payment processing

Personal information is handled in accordance with the Bin Waite Privacy Policy and applicable privacy laws.Payment information may be processed by third-party payment providers. Bin Waite does not receive or store complete card details where the payment provider handles that information directly.The Privacy Act does not cover every small business, but some small businesses remain covered depending on their activities. A clear privacy policy and appropriate handling of customer information are still prudent for an online store. 

26. Liability

Nothing in these terms excludes, restricts or modifies:

  • Australian Consumer Law rights
  • Liability that cannot legally be excluded
  • Liability for fraud
  • Liability for personal injury caused by negligence
  • Any other non-excludable legal obligation

To the extent permitted by law, Bin Waite is not liable for loss that is caused by the customer’s misuse, unauthorised modification, incorrect installation or failure to follow supplied instructions, except to the extent that Bin Waite contributed to that loss.

27. Complaints and disputes

Customers should first contact Bin Waite at:hello@binwaite.com.auPlease include the order number and relevant details.Bin Waite will attempt to review and respond to the complaint within a reasonable timeframe.If a consumer dispute cannot be resolved directly, the customer may contact NSW Fair Trading, their state or territory consumer-protection agency, or pursue another available legal remedy.Nothing in these terms prevents a customer from contacting a regulator, tribunal or court.

28. Changes to these terms

Bin Waite may update these Terms and Conditions for future transactions.Changes will not retrospectively alter an order already accepted unless:

  • The customer agrees; or
  • The change is required by law

The terms applying to an order are those presented or published when the order was placed.

29. Governing law

These Terms and Conditions are governed by the laws of New South Wales, Australia.The parties submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights the customer has to bring a matter in another jurisdiction.
